These Terms of Service (“Terms”) govern your use of the Assured Artwork website and the purchase and licensing of digital artwork provided by Assured Artwork (“we,” “our,” or “us”). By accessing our website or purchasing artwork, you agree to these Terms.

1. Services Provided

Assured Artwork offers digital artwork for licensing. All products are delivered electronically and do not include physical goods.

2. Licensing of Artwork

All artwork is licensed, not sold.

Upon purchase, you are granted a non-exclusive, non-transferable license to use the artwork in accordance with the specific license terms provided at the time of purchase.

Unless otherwise stated, you may not:

  • Resell, redistribute, sublicense, or share the artwork
  • Claim the artwork as your own
  • Use the artwork in a way that is unlawful, defamatory, or misleading
  • Use the artwork in logos, trademarks, or exclusive brand identity systems without an extended license

All rights not expressly granted remain with Assured Artwork.

3. Payment Terms

All payments must be made in full at the time of purchase unless otherwise agreed in writing.

By completing a purchase, you agree to provide accurate billing information and authorize us to charge your selected payment method.

4. No Refund Policy

Due to the nature of digital artwork and licensing:

  • All sales are final once files have been delivered
  • No refunds, cancellations, or exchanges will be issued after delivery
  • Previews or proofs may be provided prior to delivery for approval

Exceptions are limited to cases where:

  • The artwork was not delivered
  • The file is corrupted and cannot be replaced
  • The delivered work materially differs from the approved proof

5. Delivery of Artwork

Artwork will be delivered digitally via download link, email, or platform access.

It is your responsibility to ensure you can receive and access the files. Once delivered, Assured Artwork is not responsible for file loss, improper use, or third-party access.

6. Intellectual Property Rights

All artwork remains the intellectual property of Assured Artwork.

Purchasing a license does not transfer ownership. Unauthorized use of artwork may result in legal action.

7. User Conduct

You agree not to:

  • Use the website or artwork for unlawful purposes
  • Attempt to copy, scrape, or reverse-engineer any part of the platform
  • Interfere with the operation or security of the website

8. Limitation of Liability

To the fullest extent permitted by law, Assured Artwork shall not be liable for any indirect, incidental, or consequential damages arising from:

  • Use or inability to use the artwork
  • Misuse of licensed content
  • Business losses related to artwork usage

Our total liability shall not exceed the amount paid for the artwork.

9. Indemnification

You agree to indemnify and hold harmless Assured Artwork from any claims, damages, or legal expenses resulting from your misuse of the artwork or violation of these Terms.

10. Modifications to Services or Terms

We reserve the right to modify these Terms or our services at any time. Continued use of the website constitutes acceptance of updated Terms.

11. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles.
